E' opportuna la conoscenza degli elementi di diritto pubblico dell’eeconomia, acquisiti nel primo anno. Gli Studenti possono fare riferimento a quel programma.

Obiettivi formativi

Il corso presenta gli strumenti utili per consentire agli Studenti di raggiungere il metodo più adeguato ad affrontare il ragionamento giuridico e finanziario delle amministrazioni pubbliche, analizzandone i meccanismi e affrontandone i problemi. Si studiano i principi di stabilità e sostenibilità finanziaria nell’ordinamento europeo e in quello italiano; i meccanismi di stabilità nella Costituzione. Si prosegue con lo studio dei principi del sistema tributario. Infine lo studio degli aspetti giuridico-finanziari delle Regioni e il nuovo ruolo che ricoprono nell’ordinamento europeo.

The course seeks to present and value the tools useful to enable students to achieve the most appropriate approach to addressing the legal and financial reasoning of public administrations, analyzing their mechanisms and addressing problems. There follows a path that includes the law of P.A., in its most innovative institutions and connected with the economy and public finances. We continue with the study of the principles of international tax law. It concludes with the principles of the science of finance and Italian financial law and with the reflections generated by economic systems on welfare.

Der Kurs versucht, die Werkzeuge zu präsentieren und zu entwickeln, damit die Studierenden die am besten geeignete Art und Weise zu erreichen, mit den rechtlichen und finanziellen Überlegungen der Regierung, die Analyse der Mechanismen und Auseinandersetzung mit neu aufkommenden Problemen zu behandeln. Es folgt einem Weg, die das Recht des P.A. enthält, in seiner innovativsten und Institutionen für die Wirtschaft und die öffentlichen Finanzen zusammen. Weiter geht es mit dem Studium der Grundsätze des internationalen Steuerrechts. Es endet mit den Grundsätzen der öffentlichen Finanzen und das italienischen Finanzrecht und mit den Überlegungen von Wirtschaftssystemen auf Wohlfahrt erzeugt.

Lezioni frontali, discussione in aula su temi di particolare interesse, slides ed eventuali interventi di esperti del settore. Per tutti sono già disponibili le lezioni registrate su Moodle, che corrispondono alle lezioni in aula.

L’esame è orale.
In base alle ultime disposizioni dell'Ateneo, gli esami della sessione estiva 2021 ho scelto di svolgerli ancora a distanza. Il voto è espresso in trentesimi. Gli Studenti saranno divisi in gruppi di 6/7 persone e si identificheranno con la Smart card. Le modalità verranno ricordate il giorno prima dell’esame tramite e-mail.

The exam is oral in presence (18/30-30-30). The September 2020 appeal will again take place in webex Meet; from December onwards, it will be in attendance, unless the University has restrictive provisions. Students will be divided into groups of 6/7 people and will identify themselves with the Smart card. The methods and the link to connect to will be communicated the day before the exam by e-mail.

PARTE III (F.Gaboardi, Regioni. Dalla storia alla governance europea), studiare i capitoli:

X. Dall’inadeguatezza del sistema contabile regionale all’armonizzazione.

XI. Parlamento e Regioni tra neofederalismo e globalizzazione.

XII. I profili sostanziali sul controllo della spesa pubblica da parte della Corte dei Conti e suoi riflessi nella prospettiva europea.

XIII. L’etica della responsabilità.

Approfondire, per questo corso, i seguenti articoli della Costituzione (commentata) già studiati nel corso di Diritto pubblico dell'economia: 23, 53, 97, 81, 117, 118, 119, 120. Fanno parte dell'esame.

X. From the inadequacy of the regional accounting system to harmonization.
XI. Parliament and Regions between neo-federalism and globalization.
XII. The substantial profiles on the control of public expenditure by the Court of Auditors and its reflections in the European perspective.
XIII. The ethics of responsibility.
For this course, study the following articles of the Constitution (commented) already studied in the course of Public Economic Law: 23, 53, 97, 81, 117, 118, 119, 120. They are part of the exam.

Il corso di Diritto ed Economia si interseca con quello di Diritto pubblico dell’economia, costituendo una sua naturale prosecuzione ed approfondimento.

Il docente sarà a disposizione degli Studenti dopo ogni lezione, oppure tramite e-mail e quando necessario in webex.

Gli Studenti provenienti da altri corsi di laurea che intendono frequentare e sostenere questo esame, possono chiedere presso il corso di provenienza l'autorizzazione ad inserirlo nel piano carriera; ovviamente sono i benvenuti.

Timetable 2020/21:

Mon-Tue-Wed 16-18. My classes will start on September 28th.
The Law and Economics course intersects with that of Public Economic Law, constituting its natural continuation and deepening.
The teacher will be available to students after each lesson, by appointment.
Students from other degree courses who intend to attend and take this exam, can ask for authorization to include it in the career plan from the course of origin; of course they are welcome.
